Definitions
General Terms and Conditions: Mayaya’s general terms and conditions.
Mayaya: Mayayaestate B.V. is registered in the Chamber of Commerce trade register as 86189123.
Customer: any natural person, legal entity, or partnership with whom Mayaya has agreed.
Services: wellness activities, including, but not limited to, massages, floating, reiki, and all associated services, as well as making available and renting out spaces in the Mayaya house to Customers, whereby the Customer offers events to third parties at his own expense and risk and Mayaya solely facilitates the space.
No-Show: not using agreed Services without cancellation.
2. Applicability
2.1. These General Terms and Conditions apply to all offers, quotations, and agreements between Mayaya and the Customer and to all obligations and services arising from and building on them. The General Terms and Conditions also apply to any agreement involving third parties in the execution.
2.2. Deviations from and/or additions to these General Terms and Conditions are only valid if they have been confirmed in writing and expressly by Mayaya to the Customer on a case-by-case basis.
3. Services
3.1. If a Customer wishes to use one or more Service(s), these Service(s) must be reserved promptly in writing, by telephone, or electronically (online) via the website. Full or partial advance payment may be required for the reserved Service(s). Within 24 hours after an (online) reservation, the Customer will receive an email with a booking confirmation. The Customer is obliged to check the booking confirmation and immediately inform Mayaya in writing of any error concerning the booking, failing which the booking will take place as shown in the booking confirmation.
3.2. A booking is only final when Mayaya confirms this (in writing) to the Customer or when Mayaya carries out the agreement.
3.3. Mayaya is always authorized to make binding corrections to apparent errors on its website and in booking confirmation. Offers and quotations on the website and/or social media are only valid for the validity period and while supplies last.
3.4. Mayaya will, without prejudice to the provisions below, provide the agreed Service(s) as usual for Mayaya. This obligation does not apply:
a) in the event of a No-Show;
b) if the Customer does not pay a deposit and/or payment on time and/or in full;
c) if the Customer does not fulfill his/her obligations towards Mayaya in a timely and complete manner in any other way;
d) if the behavior or personal hygiene of the Customer is not following Mayaya’s standards;
e) if the Customer and/or other persons in his company and/or belonging to his party do not comply with the house rules or otherwise behave in such a way that order and tranquility in Mayaya and/or the normal business operations of Mayaya can be compromised. or is disturbed;
f) in the case of the rental of one or more rooms in the Mayaya house to a Customer, there are sufficient indications that the group session/activity(s) to be held in Mayaya on the basis of that agreement has a character that is so different from that expected by Mayaya it could be concluded on the basis of an announcement by the Customer or on the basis of the capacity of the Customer and/or the guests that Mayaya would not have agreed if it had been aware of the actual nature of the events/activity(s). been;
g) in the event of force majeure on the part of Mayaya as referred to in Article 6.
If one of these cases occurs, the Customer remains obliged to pay the invoice in full, unless otherwise agreed between the Customer and Mayaya.
3.5. If the Customer shows up late for a booking, Mayaya is entitled to reduce the lost time on the Customer’s booking.
3.6. Mayaya will execute every agreement to its knowledge and ability. If Customers are not satisfied with (part of) the Service(s) provided, the Customer must notify this in writing immediately, by 5 working days after the occurrence, via [email]. In that case, Mayaya will contact you as soon as possible.
4. No-Show and Cancellation
4.1. In the event of a No-Show, the Customer is, in all cases, obliged to pay the invoice for the agreed Service(s).
4.2. It’s your responsibility, as our valued Customer, to notify us of any cancellation at least 48 hours prior to the booking. This ensures no costs will be charged. If you cancel 24 hours prior to the booking, a 50% cancellation fee will be charged. If you cancel within 24 hours, a 100% cancellation fee will be charged.
4.3. Any cancellation must be made in writing and dated
5. Liability
5.1. The Customer uses Mayaya’s Services at his responsibility and risk.
5.2. Mayaya is not liable for damage to or loss of property or theft of property in the Mayaya house.
5.3. Mayaya is not liable for any personal injury or accident to a Customer or third parties, regardless of whether the Services are used, except in the event of intent or deliberate recklessness on the part of Mayaya.
5.4. In the event of renting one or more rooms in the Mayaya house to a Customer, the Customer indemnifies Mayaya against all claims from persons in the company and/or belonging to the Customer’s company and other third parties.
5.5. If the Customer and/or the persons in the Customer’s company and/or belonging to the Customer’s company cause damage to the Mayaya house or items are stolen, the costs for repair/replacement will be charged to the Customer.
5.6. If Mayaya can be held liable in any way for damage suffered by the Customer, Mayaya’s liability is limited to direct damage and the amount paid out by the insurer in that specific case. If the insurer does not pay out for the damage in question, or the damage in question is not covered by the insurance, Mayaya’s liability is limited to the invoice value of the agreement (excluding VAT), with a maximum of € 1,500.
6. Force majeure
6.1. In the event of force majeure, Mayaya has the choice either to suspend the execution of the agreement with the Customer until the force majeure situation has ceased to exist or to (partially) terminate the agreement. The Customer is under no circumstances entitled to any compensation. Force majeure includes (temporary) unavailability of personnel, technical malfunctions, software problems, pandemics, epidemics, fire, and special weather conditions.
6.2. If Mayaya has already partially fulfilled its obligations when the force majeure occurs or can only partially fulfill its obligations, it is entitled to invoice that part separately, and the Customer is obliged to pay this invoice.
7. Privacy
7.1. All personal data obtained in the context of the agreement will be treated strictly confidentially by Mayaya and in accordance with applicable privacy laws and regulations.
7.2. Mayaya will not use the Customer’s personal data for any purpose other than the execution of the agreement and will strictly adhere to the principle of processing only the necessary personal data for this purpose.
8. Final provisions
8.1. If one or more provisions of these General Terms and Conditions are void or annulled, the other provisions of these General Terms and Conditions will remain in full force. Mayaya and the Customer will then enter into consultation in order to agree on new provisions to replace the void or annulled provisions, whereby the purpose and scope of the original provisions are taken into account as much as possible.
8.2. Mayaya may change these General Terms and Conditions anytime, without giving reasons.
8.3. Dutch law applies to every agreement between the Parties. Disputes arising from or related to the execution of the agreement will be submitted to the competent court in Amsterdam
